Last Will and Testament of Jacob Calahan
State of Georgia
Walton County
August 4th 1863

In the name of God Amen.

I Jacob Calahan being of advanced age and feeble health but of a sound and disposing mind and memory
do make this my last will and Testament.

Item first - I desire and direct that my body be buried in a decent and Christian like manner suitable
to my condition and circumstances in life.

Item second  - I desire that all my just debts be paid by my Executor hereinafter named without delay
out of any money that may be on hand at the the of my death by my Executors hereinafter named.

Item third - I give to my wife Jane Calahan all my Estate both real and personal for her support and
conveanance during her natural life only to be controlled and managed by my Executors for her good
and comfort and the good of the Estate as to them may deem best.

Item fourth - Disposing of all unnecessary property I desire and direct that my estate be divided into
five shares or parts and that one part or fifth be given to each one of my children after adding to my
whole estate the amount already received by each one of them.

Item fifth - I have made the following advancements to my children and their husbands. To William
A. Calahan Seventeen hundred and Seventy nine dollars & 89 cents. To Josephus Calahan twenty
five hundred and thirty five dollars and 30 cents. To John L. Calahan, three thousand three hundred
and Twenty dollars & 22 cents. To James M. Smith thirteen hundred and forty two dollars & 50 cts.
To John Buchanan fourteen hundred and Twelve dollars & 35 cts.

Item Sixth - I desire and direct that should any one of my children dispute the amount placed to
there names or refuse to Settle by my books for anything already received or that may be owed
during my natural life that they be cut off with the sum of five Dollars.

I do hereby appoint and constitute my son William A. Callahan and my son in law, James
M. Smith Executors of this my last will and Testament.

Signed Sealed and delivered in presence of Testator and in the presence of each other the
day and year as above written.

Personally appeared in open court F.M. Herndon one of the subscribing Witness to the within
will of Jacob Callahan who being duly Sworn deposeth and saith that he saw said Testator
sign seal publish and deliver the within instrument as for his last will freely and voluntarily and
without any undue influence whasoever that said Testator was of sound and disposing mind
and memory & of sufficient testamentary capacity to execute a will that Deponent further says
that he subscribed said will as a witness and that he saw G.W. Garrett and John B. Davis to
other witnesses subscribe said will that he with said Garrett and Davis witnessed the same
in the presence of the Testator and of each other and at the special instance :& request of
said Testator. Sworn to and Subscribed in open Court this February 3, 1864.
